Terms & Conditions
Picnic by the River cannot be held responsible for any personal injuries, food sensitivities, or loss/damage to personal property while attending our picnics. By booking a picnic with PBTR, you agree to sign the Release of Liability Waiver.
Booking
Bookings are only fully made upon the receipt of deposit payment, booking forms and following our confirmation. Changes to a booking can be made at any stage 2 days or more prior to the booking date. This may include: date & time, number of guests, add-ons, and/or location.
Payment
To secure a picnic, a $50 deposit is required at the time of booking. Full payments are required before the picnic. Our payment options are: Venmo, Cashapp, and Zelle.
Weather
If the weather looks like it may affect your picnic reservation, we will contact you in advance to discuss your options. We always make every effort to wait as close to the picnic time as we can to see our options. If the forecast shows rain for the time of your picnic, you have up to 3 hours before the picnic to reschedule due to weather or call it off. There is no fee for rescheduling or cancelling your picnic due to weather and you will be credited to your new date if you reschedule. If bad weather disrupts completion of the picnic after the picnic has already begun, you will be refunded up to 50% of the total cost.
Cancellations
We require at least a 72 hour notice prior to your picnic for any cancellations. Due to our high number of bookings, deposits are only 50% refundable as we have held your date and turned down other picnics to do so. We also offer credits that can be applied to another picnic reservation within 2 months from your original date. Once the picnic is set up, we cannot cancel or reschedule. Picnic by the River is not responsible for refunding the full amount.
Rescheduling
If your picnic needs to be rescheduled, we will work with you to reschedule based on availability. We require at least a 72 hour notice prior to your picnic if you choose to reschedule. Otherwise, we might not be able to accommodate. For rescheduling due to weather, you have up to 2 months to set a new date.
Picnic time
Picnics are reserved for one hour. We will charge $50 per hour beyond this time frame. If you need to leave earlier than the arranged time, we ask that you contact us at least 30 minutes in advance. You are responsible for the picnic until we return to gather the picnic items. If the picnic is left unattended, you are subject to receiving an invoice to cover any damages incurred. If you choose to leave early, Picnic by the River will not offer any refunds for leaving the event earlier than anticipated.
Food Allergen
Picnic by the River is not responsible for any food allergen experience, treatment, or anaphylactic. Customer is responsible for letting us know at the time of booking of any intolerance or food allergy so we can accommodate those needs.
Breakage / Loss
Customer assumes full responsibility for any damage or loss of any picnic items, including but not limited to picnic table, blanket, pillows, glassware, flatware, décor, and/or add-ons such as board games, Fujifilm camera, vintage radio speaker, and sports basket. Any lost, stolen or damaged items will be charged to the customer at replacement cost. All items should be present at the time of clean up. Customer is responsible for the safety of all picnic items until we return to gather them.
Code of Conduct
We reserve the right to remove individuals from any picnic at any time due to inappropriate behavior, suspicion of participants being under heavy influence of alcohol and/or drugs, and unruly behavior on Chattanooga's Coolidge Park or Riverfront Park property. In such circumstances, the client will not be entitled to a refund. We will not be liable for any losses resulting from this decision. If necessary, the client will be billed for any costs incurred. We encourage all customers to visit Chattanooga's website for more information on Park rules.
Waiver & Release of Liability
In consideration of the risk of injury while participating in Picnic by the River services (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Picnic by the River, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I am voluntarily participating in the aforementioned Activity and I am participating in the Activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating in this Activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others' negligence, conditions related to travel, or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity, including travel to, from and during this Activity.
I agree to indemnify and hold harmless Picnic by the River against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Picnic by the River incurs any of these types of expenses, I agree to reimburse Picnic by the River.
I hereby certify that I understand the above risks associated with this activity and agree that Picnic by the River shall not be responsible for any injuries or losses during any event and service.
Additionally, I agree to be held solely responsible if my negligence, willful misconduct, or disregard for the rules of activity name leads to damage to others or to Picnic by the River property. I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against Picnic by the River for personal injury or property damage. In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
Any legal manners arising from this release of liability shall take place in the state of Tennessee as agreed.
